No, there is no requirement for parties to be represented.
If you do not have a sealed Financial Consent Order then yes, despite a Decree Absolute or Final Order being granted.
This records the financial agreement made between you and your spouse/civil partner.
Unfortunately, you do not have parental responsibility over your child. However, you can make an application to the Court to change this.
You should always seek independent legal advice early to see where you stand, even when both parties are amicable. If you have reached an agreement, then solicitors should be instructed to deal with the drafting of a Financial Consent Order and for filing with the Court for them to review/approve. Without a Financial Consent Order approved by the Court, there is no legally binding agreement which severs the financial ties between spouses/civil partners.
