Family Law Services

Family law, divorce proceedings

At Woodstock Legal Services we offer a full and comprehensive family law service. Our experienced family lawyers are able to provide clients with professional and empathetic advice, tailored to their needs and circumstances, but which is nevertheless cost effective.

We recognise that early advice and identification of issues can be key at the outset, of any relationship breakdown, and this may help reduce emotional turmoil and financial costs, as well as producing a better outcome. For this reason we offer a 20 minute free advice session so that at this very difficult time clients have a guiding hand.

It is key to understand your individual case as early as possible, together with your objectives, whether it be advice relating to the children, your personal and financial protection, or when dealing with financial matters; the future of the family home, spousal maintenance, limited companies/ businesses, and pensions etc.

This is so that we can provide you with the advice, support and guidance you need during this difficult time.

FAQ

  • Do you offer a fixed fee?

Contact us with your query and we may be able to offer you a fixed fee.

  • Do I need representation at Court?

No, there is no requirement for parties to be represented.

  • I obtained my Decree Absolute/Final Order, can my ex still make a financial claim against me?

If you do not have a sealed Financial Consent Order then yes, despite a Decree Absolute or Final Order being granted.

  • What is a Financial Consent Order?

This records the financial agreement made between you and your spouse/civil partner.

  • I wasn’t married to the mother of my child and my name is not on the birth certificate as the child’s father, what rights do I have?

Unfortunately, you do not have parental responsibility over your child.  However, you can make an application to the Court to change this.

  • My spouse and I are amicable and we have agreed everything, do we still need to speak to solicitors?

You should always seek independent legal advice early to see where you stand, even when both parties are amicable.  If you have reached an agreement, then solicitors should be instructed to deal with the drafting of a Financial Consent Order and for filing with the Court for them to review/approve.  Without a Financial Consent Order approved by the Court, there is no legally binding agreement which severs the financial ties between spouses/civil partners.
